Notice of Public Hearing to Adopt Rules

A public hearing will be held in Oahe Conference Room, 124 South Euclid Avenue, 1st Floor, Pierre, SD 57501 on May 19, 2026, at 1:00 P.M. (CDT) to consider the repeal of proposed rules in:

§§ 20:06:12:07, 20:06:19:04, 20:06:25:01, 20:06:25:01.01,
20:06:25:01.02,20:06:25:02, 20:06:26:01, 20:06:36:01, 20:06:59:01

The effect of amending these rules is to update the sources referenced in rule. The reason for amending these rules is to ensure parties are referring to the most recent edition of the sources.

§ 20:06:13 Appendix D

The effect of amending the rule is to update the Division’s Medicare Supplement rules. These rules incorporate the 2026 Medicare Supplement coverage amounts set by the federal government. The reason for amending the proposed rule is to ensure that enrollees are given correct plan information and allow the Division to continue to regulate these types of plans to help consumers.

Persons interested in presenting amendments, data, opinions, and arguments for or against the proposed rules may appear in-person at the hearing, or mail or e-mail the materials to the South Dakota Division of Insurance, 124 South Euclid Avenue, 2nd Floor, Pierre, South Dakota 57501 or to lisa.harmon@state.sd.us or insurance@state.sd.us (Subject Line: Proposed Administrative Rules). The deadline to submit any such written comments for consideration by Division is May 29, 2026, and materials sent by mail must reach the Division by the comment deadline to be considered.

After the public hearing and written comment period, the Division of Insurance will consider all written and oral comments it receives on the proposed rules.  The Division may modify or amend a proposed rule at that time to include or exclude matters that are described in this notice.
