Notice of Public Hearing to Adopt Rules

A public hearing will be held in Oahe Conference Room, 124 South Euclid Avenue, 1st Floor, Pierre, SD 57501 on July 29, 2024, at 9:30 A.M. (CDT) to consider the adoption and amendment of proposed rules to the following:

Chapter 20:08:03:01, 20:08:05:27, and 20:08:05:27.01

The effect of amending these rules is to implement an examination validity program and maintaining qualifications program for eligible broker-dealer agents, investment advisers, and investment adviser representatives and to update the examination requirement for investment adviser and investment adviser representatives.

The reason for amending these rules is to allow an eligible broker-dealer agent, investment adviser, or investment adviser representative who is not currently registered in South Dakota to reenter back into South Dakota via the two programs.

Persons interested in presenting amendments, data, opinions, and arguments for or against the proposed rules may appear in-person at the hearing, or mail or e-mail the materials to the South Dakota Division of Insurance, 124 South Euclid Avenue, 2nd Floor, Pierre, South Dakota 57501 or to lisa.harmon@state.sd.us or insurance@state.sd.us (Subject Line: Proposed Administrative Rules). The deadline to submit any such written comments for consideration by Division is August 8, 2024, and materials sent by mail must reach the Division by the comment deadline to be considered.

After the public hearing and written comment period, the Division of Insurance will consider all written and oral comments it receives on the proposed rules.  The Division may modify or amend a proposed rule at that time to include or exclude matters that are described in this notice.
