Our Mission

The mission of the Division of Insurance is to protect the public and make insurance available and affordable by efficiently providing quality assistance, providing fair regulation for industry, and promoting a healthy, competitive insurance market.

Who We Regulate

Under Title 58, the Insurance Code, and supporting administrative rules, the Division regulates and monitors insurance companies, various associated insurance industry entities and insurance agents who are conducting business in South Dakota. This regulatory oversight ensures all entities are properly licensed and/or registered in our state and operating in compliance with state laws and rules.

What can the South Dakota Division of Insurance do for me?

The Division of Insurance can:

  • Provide resources to consumer information about various insurance topics and issues to aid in making the best possible decision about insurance coverage
  • Assist with questions or complaints about your insurance company or insurance agent.
  • Provide resources to access companies or agents licensed to sell insurance in South Dakota.
  • Provide direction in accessing company-specific information including licensing, key financial data, rating and aggregate complaint information.
  • Provide resources to companies about licensing and filing requirements in South Dakota.
  • Facilitate the external review process for health claims by an Independent Review Organization (IRO)

The Division cannot:

  • Act as your lawyer, give you legal advice, or resolve disputes that are in litigation
  • Recommend insurance companies or products
  • Resolve a dispute when the only evidence is your word against the word of the company or agent
  • Force a company to provide your requested solution if no laws have been broken - even if you believe the company or agent has not been fair.
  • Make medical judgments or require a company to pay for services determined to not be "medically necessary." For all health claims, you must follow your plan's appeal process.
  • Handle problems with a health plan that is self-funded by an employer, issued in another state, or involves a governmental plan such as Tricare, Medicare, or the Federal Employee Benefit Plan.
  • Provide financial assistance for Federal Marketplace policies or force the Federal Marketplace to change their decisions.
