Notice of Public Hearing to Adopt Rules

This notice is to replace and correct the previous notice published pertaining to rules in Chapter 47:03:05. The date for the public hearing and the comment period have been amended as stated below. The Division of Labor and Management will hold a public hearing in the Sharpe Conference Room, Missouri River Plaza, 123 W. Missouri Avenue, Pierre, South Dakota, on May 14, 2018 at 2:00 p.m., to consider the adoption and amendment of proposed rules to the following:

Chapter 47:03:05

The effect of the rules is to revise the workers' compensation fee schedule.

The reasons for adopting these rules are to change references to the most current version of the relative values manual the department uses, and to revise the conversion factors for some medical services.

Persons interested in presenting data, opinions, and arguments for or against the proposed rules may do so by appearing in person at the hearing or by sending them to the South Dakota Division of Labor and Management, 123 W. Missouri Avenue, Pierre, South Dakota 57501.

After the hearing, the Division of Labor and Management will consider all written and oral comments it receives on the proposed rules. The comment period will remain open for ten days following the public hearing and will close on May 24, 2018. The Division may modify or amend a proposed rule at that time to include or exclude matters that are described in this notice.

Notice is further given to individuals with disabilities that this hearing is being held in a physically accessible place. Please notify the Division of Labor and Management at least 48 hours before the public hearing if you have special needs for which special arrangements must be made.
