Notice of Public Hearing to Adopt Rules - Date Certain References & Implement Group Capital Calculation Filing

A public hearing will be held in Oahe Conference Room, 124 South Euclid Avenue, 1st Floor, Pierre, SD 57501 on May 20, 2024, at 1:30 P.M. (CDT) to consider the adoption and amendment of proposed rules to the following:

§§ 20:06:12:07, 20:06:19:04, 20:06:25:01, 20:06:25:01.01, 20:06:25:01.02, 20:06:25:02, 20:06:26:01, 20:06:36:01, & 20:06:59:01

The effect of amending these rules is to update the sources referenced in rule. The reason for amending these rules is to ensure parties are referring to the most recent edition of the sources cited in the rules.

§§ 20:06:09:45 & 20:06:09:49 to 20:06:09:53

The effect of amending § 20:06:09:45 is to change a citation. The reason for amending this section is ensure the rule is referencing the correct definition within the South Dakota Codified Laws.

The effect of adopting §§ 20:06:09:49 to 20:06:09:53 is to implement the group capital calculation filing, as passed in House Bill 1059 during the 2024 Legislative Session. The reason for adopting these new rules is to establish filing criteria, exemptions, allowance for a limited filing, and qualifications for non-U.S. jurisdiction filing acceptance.

Persons interested in presenting amendments, data, opinions, and arguments for or against the proposed rules may appear in-person at the hearing, or mail or e-mail the materials to the South Dakota Division of Insurance, 124 South Euclid Avenue, 2nd Floor, Pierre, South Dakota 57501 or to lisa.harmon@state.sd.us or insurance@state.sd.us (Subject Line: Proposed Administrative Rules). The deadline to submit any such written comments for consideration by Division is May 30, 2024, and materials sent by mail must reach the Division by the comment deadline to be considered.

After the public hearing and written comment period, the Division of Insurance will consider all written and oral comments it receives on the proposed rules.  The Division may modify or amend a proposed rule at that time to include or exclude matters that are described in this notice.

Notice of Public Hearing to Adopt Rules - Update Medicare Supplement Coverage Amounts

A public hearing will be held in Oahe Conference Room, 124 South Euclid Avenue, 1st Floor, Pierre, SD 57501 on April 15, 2024, at 9:30 A.M. (CDT) to consider the adoption and amendment of proposed rules to the following:

Chapter 20:06:13 Appendix D

The effect of this rule will be to update the Division's Medicare Supplement rules. These rules incorporate the 2024 Medicare Supplement coverage amounts set by the federal government.

The reason for amending the rule is to ensure that enrollees are given correct plan information and bring our Medicare Supplement rules into compliance with federal regulations. This will allow the Division of Insurance to continue to regulate these types of plans and assist consumers.
