The "six-in-one" labor law compliance poster is available at no cost for all South Dakota employers. You can request copies from your Job Service office.

Offers from private companies for state or federal posting requirements for a fee are scams and should be reported to the Attorney General's Office of Consumer Protection.

Submissions Wanted for National Apprenticeship Week

National Apprenticeship Week (NAW) brings together business, labor, education, and other partners to celebrate and showcase the benefits apprenticeship programs offer in closing the skills gap in the workforce.

In recognition of NAW (Nov. 15-21), the Department of Labor and Regulation (DLR) would like to highlight employers’ apprenticeship program by sharing brief videos from their apprentices or a story about their apprenticeship programs.

For video tips and details on submissions, see our National Apprenticeship Week Toolkit. Submissions are due Monday, Oct. 25.

South Dakota Workforce Report: 2020 Labor Market in Review

The Labor Market Information Center (LMIC) recently published the South Dakota Workforce Report. It recaps South Dakota's 2020 labor market (with insights into the COVID-19 pandemic's impacts) and includes updates on recovery, based on 2021 data available to date.

The report covers:

  • Labor Force, including participation rates, unemployment rates, and data on those not currently in the labor force

Minimum Wage to Increase Jan. 1

State Minimum Wage to Increase Jan. 1

The state minimum wage will increase from $9.45/hour to $9.95/hour effective Jan. 1, 2022.

The hourly minimum wage for tipped employees will be $4.975/hour effective Jan. 1, 2022, half the minimum wage for non-tipped employees. Wages and tips combined must equal at least the minimum wage.

The minimum wage is annually adjusted by any increase in cost of living, as measured by the Consumer Price Index published by the U.S. Department of Labor. In no case may the minimum wage be decreased.

U.S. DOL Announces Publication of Final Rule on Tip Regulations under the Fair Labor Standards Act

On Sept. 23, 2021, the U.S Department of Labor announced publication of the Tips CMP final rule, which restores the department’s ability to impose penalties of up to $1,100 per violation against employers who take tips earned by their employees, regardless of whether those violations are repeated or willful.

Additionally, the final rule clarifies while managers or supervisors may not receive tips from mandatory tip pools, they are not prohibited from contributing tips to eligible employees in such pools.

The final rule withdraws two portions of the 2020 Tip final rule related to the assessment of Civil Money Penalties (CMPs) and finalizes proposed changes to those portions of the 2020 Tip final rule.

The final rule becomes effective Nov. 23, 2021. For details, please visit Tip Regulations under the Fair Labor Standards Act.
