![]() Equal Employment Opportunity Commission Releases Update to Federally Required Poster The U.S. Equal Employment Opportunity Commission (EEOC) has released an updated "Know Your Rights" poster that covered employers are required by law to display at the work site. It replaces one of the EEOC's most visible documents, the “EEO is the Law” poster which was last updated in 2009. The new poster summarizes the laws enforced using plain language, bullet points and bold colors. The substantive updates include noting harassment is a prohibited form of discrimination and sex discrimination includes discrimination based on pregnancy and related conditions, sexual orientation or gender identity. It also contains updated contact details for the EEOC, including a QR code that directs readers to the EEOC webpage on how to file a charge of discrimination. The federal 6-in-1 poster DLR provides at no cost is being revised and should be available later this winter. In the meantime, the new poster is available on the EEOC website in English and Spanish for employer use. The available formats include a version for screen readers/electronic posting and a version for printing and posting in a physical workplace. The poster will be translated into other languages as quickly as possible given the importance of language accessibility. ![]() National Apprenticeship Week Emphasizes Value of Registered Apprenticeships National Apprenticeship Week (NAW) brings together business, labor, education and other partners to celebrate and showcase the benefits apprenticeship programs offer in closing the skills gap in the workforce. The Department of Labor and Regulation (DLR) will highlight South Dakota employers’ apprenticeship programs by sharing brief videos from their apprentices or stories about their apprenticeship programs at StartTodaySD.com and on our Start Today SD Facebook page. DLR will also host two virtual panels covering apprenticeships from the apprentices’ and sponsors’ perspectives. ![]() Reemployment Assistance Employee Notification Posting Requirement Revised South Dakota law requires a workplace posting informing employees about availability of reemployment assistance (unemployment compensation). This posting has been revised to conform with additional U.S. DOL requirements and to update the list of Job Service offices. This posting notice must be provided by employers to workers individually and at the time of separation. Employers have flexibility in the method of communication to meet this requirement (such as letters, emails, text messages or flyers). The posting is available in English and Spanish to download from DLR’s website. You may also request a hard copy from DLR at no charge by calling 605.626.2312.
![]() State Information Data Exchange (SIDES) Updates Recent updates to the State Information Data Exchange System (SIDES) will impact filing reemployment assistance claims for seasonal layoffs. Temporary Layoff. If you are laying off an employee, but intend to call the person back to work, enter the reason for separation as “Temporary Layoff.” You will be prompted to provide recall date information. Laid Off/Lack of Work. If you have no intent to recall the employee, enter the reason for separation as “Laid Off/Lack of Work.” We appreciate you using SIDES as a secure, electronic, and standardized format to respond to our claim notices and information requests. This helps us both save time and money. Your employees will notice we have a new RA claims online system. They will need to create a single sign on (SSO) account to proceed.
