Labor Department Offering Workforce Knowledge Session on Wage Practices

South Dakota businesses and organizations are invited to attend the Department of Labor and Regulation’s next Workforce Knowledge Series session titled “Compensation: Making Heads or Tails of Pay Decisions.”

This online event will take place on Thursday, May 8, at 11:30 a.m. CDT/10:30 a.m. MDT via Microsoft Teams.

Ask yourself these questions:

  • Does your business have a clear compensation plan or strategy?
  • Do you make decisions based on research?
  • Do you know where to find trustworthy and accurate information?

This session on compensation is an invaluable opportunity for employers and organization leaders to align their compensation approach with workforce needs and market trends. You’ll get practical guidance for evaluating your company’s compensation system, learn to make pay decision using solid research, and get actionable tips to help you align your compensation approach with both workforce needs and current market trends.

To join the event, you’ll need to register through the Event Calendar Entry, which will prompt you to log in using your mySD single sign-on credentials. Once registered, you will receive a confirmation email with access details and a calendar invite for the session.

Independent Contractor vs Employee

Independent Contractor vs. Employee

Contract labor is often misunderstood and misused in the business world.
You can’t assume that casual, temporary, or part-time workers (or even workers who sign independent contractor agreements) are truly independent contractors. Giving someone a 1099 form and not withholding taxes does not automatically make them an independent contractor.

What is an INDEPENDENT CONTRACTOR?

According to South Dakota Codified Law 61-1-11, work done for wages is considered covered employment unless both conditions are met:

  1. The worker is free from your control or direction when doing their job, and
  2. The worker is usually engaged in their own trade, occupation, profession, or business.

Know the LAW.
Even if your lawyer or accountant prepares a contract, and even if the worker signs it, that alone doesn’t mean you are following the law.
A worker cannot give up their right to Reemployment Assistance just by signing an agreement. They must meet the independent contractor rules to be considered anything other than your employee.

Understand the CONSEQUENCES.
If you wrongly classify an employee as an independent contractor, you could owe back taxes, penalties, and interest. You could also be responsible for paying Federal Unemployment Taxes (FUTA) and other federal taxes, including Social Security and Medicare.
