![]() File Bulk Unemployment Claims DLR is accepting bulk unemployment claims related to COVID-19 from any employer laying off over 50 workers. The employer can file on behalf of the individuals. This means individuals do not file an initial claim but must complete the weekly request for payment. Workers Must Return to Work When Recalled Workers who have been placed on a temporary layoff related to COVID-19 but refuse to return to work when recalled by their employer will lose unemployment benefits, except for certain circumstances. View guidance. Businesses should report employees who refuse to return to work without good reason or who quit their jobs to RAFraud@state.sd.us as soon as possible. The CARES Act specifically provides for serious consequences for fraudulent cases. Individuals are responsible for paying back benefits deemed as overpayments due to ineligibility. ![]()
Revised Employee Notification Posting Requirement South Dakota law requires a workplace posting informing employees about availability of reemployment assistance (unemployment compensation). This posting has recently been revised to conform with additional U.S. DOL requirements. Per new guidance under UIPL 13-20, this posting notice must be provided by employers to workers individually and at the time of separation. Employers have flexibility in the method of communication to meet this requirement (such as letters, emails, text messages or flyers). Since the week ending March 21, an average of 5,600 claims have been processed weekly. In typical times, an average of 150-180 claims are processed each week. Sixty current employees have been trained to help the Reemployment Assistance Division. DLR issues a news release every Thursday morning with new numbers on initial weekly claims, benefits paid out and continued claims. View DLR Newsroom.
