Overpayments - Employer Responsibilities

Maintaining the integrity of the Unemployment Insurance (UI) system is a top priority for the South Dakota Department of Labor and Regulation. Your help as an employer is vital. The UI Benefit Payment Control Unit engages in many activities designed to discover and collect overpayment of UI benefits. As an employer you may receive requests for information on former and current employees. When you receive a request for information, please review, complete and return the form promptly. Quarterly Audit of Wages and Benefits Paid (Form 222)

Description: This form requests weekly wage information on claimants who collected UI benefits during the same quarter that an employer paid wages to the claimant.

Purpose: To discover claimants who earned wages and also were paid UI benefits during the same week/weeks. If there is a match, the claimant may be found overpaid and required to pay back UI benefits. If a claimant is found overpaid and an employer's tax account was charged, the employer's tax account may be credited the overpaid amount.

New Hire Crossmatch (Form NH-1)

Description: This form requests weekly wage information on claimants who were recently reported to the New Hire Reporting Center. Visit the New Hire Reporting portion of this website for information on your responsibility as an employer to report newly hired employees.

Purpose: To discover claimants who returned to work and were paid UI benefits after they began working. If there is a match, the claimant may be found overpaid and required to pay back UI benefits. If a claimant is found overpaid and an employer's tax account was charged, the employer's tax account may be credited the overpaid amount.

Work Search Verification (Form WS Employer)

Description: This form requests information about a job contact with the employer reported by the claimant.

Purpose: To ensure that claimants make an honest and reasonable effort to become re-employed. Visit the UI Benefits portion of this website for information on job contact requirements.
