Who Pays First — Coordination of Benefits Among Multiple Plans
When multiple policies are involved where dependants are concerned, generally benefits are determined in the following order:
First, the plan of the parent with custody of the child.
Second, the plan of the new spouse of the parent with custody of the child.
Third, the plan of the parent not having custody of the child.
However, if there is a court decree stating that one of the parents is responsible for the health care expenses, and this parent is aware of this stipulation, the benefits of that are determined first.
